Practice Work Shop (PWS) On ‘Whether Fixing Royalty Rates With Intervention Of Courts Is In Keeping With A Market Economy?’

During last week’s Practice Work Shop (PWS) Session, Ashok Vardhan Adipudi, Trainee Associate (Patents), led a discussion on whether fixing of global royalty rates by Courts is in keeping with a market economy. The session saw an engaging discussion with attorneys expressing their views on the advantages and disadvantages of such interventions and the impact it could have on the market for Standard Essential Patents. The session also saw some interesting points on what factors relevant to the Indian market could be accounted for in such calculations by Courts and/or in other forms of royalty fixing.
