Publication: India: Ability to Sue for Infringement—Trademark vs. Copyright; Published in INTA Bulletin

ALG Partner Abhimanyu Kumar reports in the INTA Bulletin, the Bombay High Court’s order in Sanjay Soya Private Limited v. Narayani Trading Company [I.A. No. 5011 OF 2020 in Commercial IP Suit No. 02/2021]. The court vide its order dated March 9, 2021, while injuncting the defendant from using the plaintiff’s registered mark SOYA DROP and copyrighted work, held that unlike in trademarks, copyright registration is not mandatory to claim reliefs under the Copyright Act, 1957.
