A ‘Special Legal Issues Seminar – General IP’ (LIS-GIP) was conducted by Vanshika Gupta, Associate and Nadra Jawaid Mallick, Trainee Associate, on “Year in Review – Notable IP Developments: Quarter 4 (October to December)”. The seminar discussed notable Court decisions from the fourth quarter of 2024 in the practice areas of Trademarks and Copyright. The seminar was the fourth and final leg of the “Year in Review Series” for discussing all the notable developments from 2024.

Practice Work Shop (PWS) On ‘Should Trade Secret Protections Be Re-Evaluated When They Pose A Potential Risk To Public Health And Safety?’

During the last PWS session, Amal Riaz, Trainee Associate, led a discussion on “Should Trade Secret Protections Be Re-evaluated When They Pose a Potential Risk to Public Health and Safety?” The session began by examining the role of trade secrets in the health sector, weighing their benefits against potential drawbacks. A key point of discussion was the impact of trade secrets on biologics, particularly how they hinder the development of biosimilars. Historical cases, such as the South African HIV/AIDS crisis and the COVID-19 pandemic, were examined to highlight the tension between corporate secrecy and public welfare. The session then explored AI’s growing role in challenging existing trade secret frameworks, raising questions about ownership and protection and whether companies should be compelled to disclose information regarding harmful substances in the medical sector. The session concluded with the consensus that there exists a need for a balanced approach to ensure trade secret protections do not obstruct healthcare advancements or global health equity.
