A ‘Special Legal Issues Seminar-General IP’ (SLIS-GIP) was conducted by Sunidhi Bansal, Associate, on ‘‘CPC Order XI Rule 14 – Different Types of Documents in Different Types of IP Law Suits’’. The seminar looked into the powers of courts under Order XI Rule 14 of Code of Civil Procedure, 1908, to order production of documents and the factors that courts look into while exercising their discretion. The session concluded with an interesting discussion about the production of documents with confidential information and the concept of “confidential clubs”.

During last week’s Practice Work Shop (PWS) Session, Aishwarya Pande, Associate, lead a discussion on whether use of fluid marks increases brand/consumer engagement or dilutes the original mark. The session witnessed an engaging discussion on the reasons behind the increasing use of fluid marks as a popular marketing tactic, especially in the post-pandemic world. The discussion then progressed to analyse the economic, societal as well as legal aspects revolving around use of fluid trademarks, in particular, the dilution of the underlying mark on account of repeated changes/variations. The session also delved into whether use of fluid marks would be an advisable marketing strategy for relatively newer brands/companies.

A ‘Legal Issues Seminar-General IP’ (LIS-GIP) was conducted by Shreya Kunwar, Trainee Associate, on ‘Whether Street Art & Graffiti can be Protected as Artistic Works Under Copyright Law?’. The seminar explored the various requirements for an artwork like graffiti to be protected under copyright law, and discussed a few examples of how the rights of street artists are protected and enforced in other jurisdictions. The session concluded with some interesting questions and discussion among the team on the concepts of vandalism and commissioned artwork.
