ALG Alum Amongst WTR300

Legal Issues Seminar- General IP (LIS-GIP) on “Whether Section 65A of the Copyright Act, 1957 provides an Exception for Fair Dealing?”

A ‘Legal Issues Seminar-General IP’ (LIS-GIP) was conducted by Siddharth Varshney, Associate, on “Whether Section 65A of the Copyright Act, 1957 provides an exception for Fair Dealing?”. The seminar delved into the need of anti-circumvention provisions in India’s growing digital landscape. Specifically, the seminar looked into the provisions relating to infringement and “fair dealing” of copyrighted works, while also examining the applicability of anti-circumvention provisions. The session concluded with some interesting questions and discussion among the team, including whether the use of VPN software to access copyrighted works will attract anti-circumvention provisions.

Practice Work Shop (PWS) on ‘Will a Shorter Copyright Term be Beneficial to Public Interest?’

During last week’s Practice Work Shop (PWS) Session, Aishwarya Pande, Associate, led a discussion on whether a shorter term of copyright protection will promote public interest. The session saw an engaging discussion with attorneys delving into the pros and cons of longer term of copyright protection and how it affects public interest vis à vis private right owner’s interests. The session also explored the ideas of how a shorter term would foster creativity and allow greater accessibility to shared knowledge.

Legal Issues Seminar- General IP (LIS-GIP) on “Whether Expenditure Incurred for Procuring Software from a Non-Resident is Taxable as Royalty?”

A ‘Legal Issues Seminar-General IP’ (LIS-GIP) was conducted by Shreya Das, Associate, on “Whether Expenditure incurred for procuring Software from a Non-Resident is Taxable as Royalty?”. The seminar delved into the important legal provisions under Income Tax Act, 1961 on Tax Deducted at Source (TDS) and Royalty, and precedents on the applicability of TDS on payment made to a non-resident for software purchases in India. Specifically, the seminar looked into the recent landmark decision of the Supreme Court in Engineering Analysis Centre of Excellence Private Limited v. CIT [Civil Appeal Nos. 8733-8734 of 2018], in which it was held that the payment made to a non-resident for procuring software does not include Royalty, and hence cannot be deducted as TDS.

ALG’s Book & Movie Club Discusses “The Little Things” (2021) –

ALG’s in-house cinephiles got together virtually last Saturday to discuss John Lee Hancock’s latest psychological thriller film, “The Little Things”. With a deep dive into the interesting characters, screenplay, theme and direction of this dark period film, the team travelled back in time to the 90s (when Hancock originally wrote the movie script)! The session also involved friendly quips about thriller movies today as against those in the 90s.
