Practice Work Shop (PWS) On ‘Whether Fixing Royalty Rates With Intervention Of Courts Is In Keeping With A Market Economy?’

During last week’s Practice Work Shop (PWS) Session, Ashok Vardhan Adipudi, Trainee Associate (Patents), led a discussion on whether fixing of global royalty rates by Courts is in keeping with a market economy. The session saw an engaging discussion with attorneys expressing their views on the advantages and disadvantages of such interventions and the impact it could have on the market for Standard Essential Patents. The session also saw some interesting points on what factors relevant to the Indian market could be accounted for in such calculations by Courts and/or in other forms of royalty fixing.

Sharing Of Reflections (SoR) Session Of ALG’s July 2021 General IP Interns

General IP Interns – Aakaanksha Akella, Gazal Sancheti and Mannika Gupta (Final Year Interns); Kirtika Shukla, Himani Jaruhar, Radhika Bhatti, Shereen Samant and Hiranmayee Ramesh (Pre-Final Year Interns) have successfully completed their Internship at ALG. At the end of their internship, they obliged us with their thoughts and ideas during the Sharing of Reflections (SoR) sessions. Their presence enriched the firm while they interned here. Legal Issues Seminar- General IP (LIS-GIP) on “Whether Section 65A of the Copyright Act, 1957 provides an Exception for Fair Dealing?”

A ‘Legal Issues Seminar-General IP’ (LIS-GIP) was conducted by Siddharth Varshney, Associate, on “Whether Section 65A of the Copyright Act, 1957 provides an exception for Fair Dealing?”. The seminar delved into the need of anti-circumvention provisions in India’s growing digital landscape. Specifically, the seminar looked into the provisions relating to infringement and “fair dealing” of copyrighted works, while also examining the applicability of anti-circumvention provisions. The session concluded with some interesting questions and discussion among the team, including whether the use of VPN software to access copyrighted works will attract anti-circumvention provisions.

Practice Work Shop (PWS) on ‘Will a Shorter Copyright Term be Beneficial to Public Interest?’

During last week’s Practice Work Shop (PWS) Session, Aishwarya Pande, Associate, led a discussion on whether a shorter term of copyright protection will promote public interest. The session saw an engaging discussion with attorneys delving into the pros and cons of longer term of copyright protection and how it affects public interest vis à vis private right owner’s interests. The session also explored the ideas of how a shorter term would foster creativity and allow greater accessibility to shared knowledge.
