Practice Work Shop (PWS) On “Should Copyright Distinguish Cultural Exchange From Cultural Appropriation?”

During the last PWS session, Vanshika Gupta, Associate, hosted a discussion on “Should Copyright Distinguish Cultural Exchange from Cultural Appropriation?”. The session explored the ethical boundaries of creative borrowing, particularly where commercially successful creators draw inspiration from culturally significant expressions and traditions.

The discussion examined whether commercial creators should voluntarily engage with source communities through attribution, consultation, collaboration, or benefit sharing, even where not legally required. It considered the risk that overly restrictive expectations may impede artistic freedom and cross-cultural exchange, while acknowledging concerns of exploitation where communities lack bargaining power. Ultimately, the session explored how cultural borrowing can be approached responsibly while balancing respect for source communities with the freedom to innovate and create.
