Legal Issues Seminar-General IP (LIS-GIP) On “Can Infringement Action Be Taken Against Another Registered Proprietor?”

A ‘Legal Issues Seminar – General IP’ (LIS-GIP) was conducted by Megha Hurkat, Associate on “Can infringement action be taken against another registered proprietor?”  

The seminar discussed various interpretations of rights of proprietors in cases of similar or identical trademark registrations by the Courts. Through key judgments, the seminar explored judicial opinions wherein some Courts have recognized the right to sue for infringement against another registered proprietor, and on the other hand other Courts have held that no infringement action can be instated against another registered proprietor. The session concluded with the observation that while registration grants enforceable rights against the world, it does not necessarily extend those rights against other registered users, indicating a need for clearer legislative guidance.
