Legal Issues Seminar (LIS) on ‘Analysis of jurisdiction under CPC vis-à-vis specific IP laws’

A ‘Legal Issues Seminar’ was conducted by Janaki Arun, Associate, on The Code of Civil Procedure, 1908 (CPC) in the context of IP Enforcement. The seminar provided an insight into the initial stage of availing jurisdiction of the Court and the legal issues ininterpretation of the provisions concerning jurisdiction under the CPC, the Trade Marks Act, 1999 and the Copyright Act, 1957. First in a 10-session module, the seminar also elaborated on the factors determining jurisdiction in suits pertaining to online infringement.

The final LISS session for the year concluded with interesting questions from the team on the effect of the Delhi High Court decision in the Ultra Home Construction Pvt. Ltd. v. Purushottam Kumar Chaubey vis- à-vis the position established by the Supreme Court in IPRS v. Sanjay Dalia and Ors., the effect of not disputing jurisdiction in earlier stages of the suit, etc.

Special Legal Issues Seminar (SLIS) on ‘Draft Data Center Policy’

A Special ‘Legal Issues Seminar’ was conducted by Sri Lekha, Associate & Gaurav Bhalla, Partner, presenting the Firm’s Submissions made in response to the draft Data Centre Policy published by the Ministry of Electronics & Information Technology (MeitY) in November, 2020. Held as part of the ‘Continuing Legal Education’ program, the Seminar provided interesting insights into data centres, the problem areas identified in the policy, proposed reforms and ALG’s comments and suggestions (accessible here).

The session concluded with interesting questions from the team on the working of data centres, utility corridors, provisions under the Essential Services Maintenance Act, 1968 and the potential challenges in growth of the data centre sector arising from the lacunae in personal data protection laws. ALG’s Nayantara Malhotra recently delivered a webinar on ‘Introduction to Trademarks’, which was organized by Lex Macula. She covered various aspects of trademark law such as meaning of a trademark, types of trademarks, benefits of selecting a good trademark, trademark registration process, conditions for registration and importance of registering trademarks. She also shared tips for successfully securing internships, and answered questions regarding pursuing a career in the field of IP.

Legal Issues Seminar on Protection and Enforcement of Domain Names under the INDRP

A ‘Legal Issues Seminar’ was conducted by Aditi Roy Chowdhury, Associate, on Protection and Enforcement of Domain Names under IN Dispute Resolution Policy (INDRP). The seminar discussed the scope, grounds of complaint, available remedies and gaps in the INDRP with the help of relevant case laws. It also provided insights on the recent amendments in the INDRP and INDRP Rules of Procedure.

The engaging session invited interesting questions from the team on confiscation of domain names, evidentiary requirements for initiating complaints based on the ground of ‘bad faith’, use of domain name registrations in claiming prior use for trademark applications and the effect (if any) of privacy protection shields in lodging a complaint, etc. The presentation can be accessed here.

Practice Work Shop (PWS) on ‘Bringing IP closer to the classrooms’

As a part of ALG’s Practice Workshop Series, Sneha Tandon, Associate, lead a discussion on ‘Bringing IP closer to the classrooms’. The discussion saw the associates engaging in a debate on whether IP should form a part of the curriculum for high school students and the extent of dissemination of IP knowledge required in the country.
