ALG’s Pranay Bali, Principal and Nayantara Malhotra, Senior Associate, recently wrote an article titled ‘To Block or Not to Block?: Analyzing the Efficacy of Website Blocking Orders and Dynamic Injunctions in Combating Digital Piracy’ which has been published in the National Academy of Legal Studies and Research (NALSAR)’s ‘Indian Journal of Intellectual Property Law’ (Vol. 11). In the article, they have examined the extent of digital piracy and its adverse economic impact, particularly in the context of the COVID-19 pandemic; the judicial enforcement measures to prevent or reduce digital piracy applied by Courts internationally and in India; the efficacy and proportionality of these measures and ways to improve the same.

ALG Partner Abhimanyu Kumar reports in the INTA Bulletin, the Bombay High Court’s order in Sanjay Soya Private Limited v. Narayani Trading Company [I.A. No. 5011 OF 2020 in Commercial IP Suit No. 02/2021]. The court vide its order dated March 9, 2021, while injuncting the defendant from using the plaintiff’s registered mark SOYA DROP and copyrighted work, held that unlike in trademarks, copyright registration is not mandatory to claim reliefs under the Copyright Act, 1957.
