ALG Partner Aparna Sreedhar reports in the INTA Bulletin the Delhi High Court’s Order in Designarch Consultants Pvt. Ltd. & Anr. v. Jumeirah Beach Resort LLC [I.A. No. 7792/2020 in CS(COMM) 366/2020)]. The Delhi High Court, vide its order dated January 19, 2021, extended the ex-parte ad-interim injunction restraining the defendant, Jumeirah Beach Resort LLC, from making any threat to the plaintiff, Designarch Consultants Pvt. Ltd., in relation to its registered trademark BURJNOIDA or the logo or design of the plaintiff’s Burj Noida building.

Publication: New Design Amendment Rules Come into Force; Published in INTA Bulletin

ALG Partner Ashwani Balayan, member of INTA’s Designs Committee, co-authored INTA Bulletin’s Law & Practice update on India’s Design (Amendment) Rules, 2021. The Amendment Rules, which came into force on January 25, 2021, amend the Design Rules with respect to adoption of Locarno Classification, recognition of Start-ups as separate category of applicants, streamlining of official fee structure, and address for services. Earlier, in November 2019, INTA had submitted its comments to the Draft Rules.

Publication: March 2 Hearing on Well-Known Marks in India; Association Weighs In; Published in INTA News

ALG Partner Gaurav Bhalla reports in the INTA Bulletin that the High Court of Delhi will hold a hearing on March 2 to decide whether the Trade Marks Registry should automatically add a mark to its List of Well-Known Marks once a court has declared it as Well-Known. Earlier in July, 2020 INTA had, through the Asia Pacific sub-committee (including Gaurav Bhalla) of INTA’s International Amicus Committee, filed an amicus brief in the case, submitting INTA’s position that a mark once declared as well-known by a Court should be included automatically in the list (of well-known marks) and there shouldn’t be any requirement to follow the administrative procedure of applying to the Trade Marks Registry for determination of the mark as well-known.
